Terms and conditions

CONSENT:
The parties express their willingness to enter into the following terms and conditions, the legal nature of which is the provision of video and/or photography services. The SERVICE PROVIDER undertakes to provide the service in accordance with the provisions of this Contract and its Annex, which form an integral part thereof. The CONSUMER, therefore, agrees to pay a certain and determinate price.

OBJECT:
The object of the terms and conditions is the video and/or photography service, the characteristics and costs of which are detailed in the Annex. The SERVICE PROVIDER will use high-quality technical equipment, including 4 Nikon Z line cameras, DJI wireless microphones, and a DJI drone, to achieve optimal results according to the requested service.

PRICE OF THE SERVICE:
The parties confirm that the total price to be paid by the CONSUMER, as consideration for the video and/or photography service, is established in the Annex to this Contract, which forms an integral part thereof.

METHOD AND PLACE OF PAYMENT:
Upon signing this Contract, the CONSUMER must pay an advance payment, the amount of which is indicated in the Annex, and the remaining balance on the date of delivery of the requested material. Payments can be made in cash, in cash or by bank transfer, in the national currency or at the exchange rate published in the Official Gazette of the Federation.

PLACE AND TIME FOR THE PROVISION OF THE SERVICE:
The shooting and delivery of the agreed videos and/or photographs will take place at the location, day, and time specified by the CONSUMER. In the case of service provision in restricted access locations, the CONSUMER must obtain the necessary authorizations.

STORAGE:
If the CONSUMER does not collect the material on the agreed date, after 30 calendar days from the delivery date, the SERVICE PROVIDER may apply the conventional penalty specified in this Contract. The material will be kept for 12 months from the date of signing the Contract and will be delivered to the CONSUMER in digital format via cloud and USB.

If after 6 months from the material’s delivery date the CONSUMER has not provided the necessary information or actions to proceed with additional services (e.g., photo printing, photobooks, USB delivery), any previous payment for these services will no longer cover their cost, and new charges may apply for continuation.

OBLIGATIONS OF THE PARTIES:
THE SERVICE PROVIDER:
Will comply with what is established in this document.
Will provide the necessary information requested by the CONSUMER.
Will inform the CONSUMER about prices, rates, conditions, and total cost of the Service.
Will deliver the material within the agreed-upon timeframe.
THE CONSUMER:
Will comply with what is established in this document.
Will make payments as agreed.
Will manage the necessary authorizations and permits for services in restricted access locations.
SERVICE MANAGEMENT:
The SERVICE PROVIDER’s management process is tentative and is not considered final or binding. The information provided in the Media Management Form serves only as a reference to understand and approximate the activities within the agreed schedule.
The SERVICE PROVIDER is not responsible for recording or guaranteeing all details or activities listed in the form, as these are subject to coordination with other vendors or the CONSUMER’s designated manager (e.g., wedding planner, DJ, venue coordinator).

SERVICE CANCELLATION:
No monetary refunds will be made for contract and/or event cancellation. The CONSUMER has a free date change option if requested at least 3 months in advance and subject to availability.

CONTRACT TERMINATION CAUSES:
This Contract may be terminated in the following cases:

If the service does not conform to what is stipulated in the Contract and its Annex.
If the CONSUMER does not make payments as stipulated.
If the CONSUMER does not allow access to the SERVICE PROVIDER’s personnel to the event facilities.
MODIFICATIONS TO THE TERMS AND CONDITIONS:
Notice of Modifications: The SERVICE PROVIDER reserves the right to make modifications to these terms and conditions at any time, in order to improve and adapt our services. These modifications will be effective upon publication on our website. By signing this Contract, the CONSUMER expresses their understanding and acceptance that the terms and conditions may undergo periodic changes. Consumers will be responsible for regularly reviewing these terms and conditions, which will be available on our website.

USE OF MATERIAL FOR ADVERTISING PURPOSES:
The SERVICE PROVIDER reserves the right to use the material for advertising purposes on its communication channels.

MATERIAL DELIVERY:
The maximum delivery date is 60 business days from the event. The material will be delivered progressively from the day of recording, either in digital or physical format, as agreed.

DELIVERY OF PHOTOGRAPHS:
Throughout the event, photographs will be taken, and all effective shots will be delivered. An effective shot is one in which the photograph is not blurry, damaged, or with objects or people crossing. The number of effective photographs delivered will depend on the event, ranging from 50 to 1,000. From these photographs, the CONSUMER will select those to be edited and printed, as indicated by their package.

VIDEO AND PHOTO EDITING:
The editing of the video material will be carried out in a cinematic or short film format, according to the decision of the post-producer, to achieve optimal results.
